Archived Images and Text
Most of the images and graphics on this site are not my own and are taken from sources across the internet. It is difficult to know the original source for each image, and therefore difficult to know who or how to credit an image. If watermarks are included on an image or some other credible source is mentioned, these are not edited out. I chose the images because I find them useful, beautiful, or they illustrate the key points of the associated text, but, the images were mostly part of the original posting. Subjects in realistic AI (Artificial Intelligence) images and subjects who are real persons in images are all presumed to be over the age of 18, or such an image is exempt from Title 18 U.S.C. §2257. When a custodian of records is easily identified in the original site, that information may also be included herein.
When an archive entry is created, it may also include images, but these are from the archive of the original web page and from other web pages having the same topic. I use archive.org as a primary source, as most archive entries are from sites that are no longer being published or where the entries are not found in a corresponding live site. Example: Images and text archived from a bdsmlr.com user may have images from the tumblr.com blog from the same user, whether directly from a live site or indirectly from archive.org.
For image or text, I will attempt to make contact with the original site owner before creating, publishing for public viewing, and announcing archive entries. When a site gives a reference to a specific author, I will also attempt to make contact using the author’s contact information, if any is provided by the site. When a working contact method is identified, I would request permission to archive the graphic or text herein under a Creative Commons License. In any case, if the contact method is internal to an unpublished site, the email address is no longer valid, or there is no response to such a request within a reasonable time, then it would be a valid assumption that all content from the original site or the identified author is totally abandoned to the public domain. Regardless of whether a license to use is granted or the material is presumed to be in the public domain, attribution to the source and author, if any are identified, will be included.
Text Compliance with USA English
When the source site has text written in a foreign language (written in a language other than USA English), Google Translate may have been used to render a text version in USA English. For all entries on this site, Grammarly.com has been used to ensure readability and to ensure compliance with U.S. English spelling, punctuation, and grammar rules.
Attribution
For attribution, the Archivist will include the URL (Uniform Resource Locator) of the source for the material (any image or written work). For multiple blog sites (i.e., tumblr.com, twitter.com, bdsmlr.com), the username indicating the poster is typically included in the URL; additionally, the date retrieved will be included, and a date when the material was posted if that information is easily retrievable. The posting chain back to an OP (Original Poster) may be included as a note, but the Archivist is not obliged to do so. If an author is indicated within a written work, then when the full work is archived, the available author's information will be included.
Archived material may exist in several URLs and locations due to reblogging in-site and reblogging across multiple sites, where the OP may not be easily identified. The Archivist is not bound to perform an extensive search for any attribution other than to include a location where the material being archived was found.
If the material is from archive.org, the full URL will include the archive.org capture data. As such information is available, attribution for images will be given to both the photographer/producer and, IP (Intellectual Property) holder, as well as for any real person in the image. As much as possible, existing watermarks will be retained.
If the author, photographer, or other party with a valid IP interest in the material that I have archived here desires attribution, or more complete attribution, then please email me, and I will act on your request to include the additional information you provide.
Take-Down Requests
If the author or other party with a valid IP interest in material (any image or written work) that I have archived here makes contact to have the material removed, I will act on your request directly to unpublished, make private, or remove the entry. A public index entry may remain within this archive for any private, unpublished, or removed archive entry.
Please note: Material (text &/or images) created using AI is considered not copywritable as it is not considered “created” by an individual, i.e., the process may have IP protection either as a trade secret or as a patentable work, and the instructions to create the corresponding material may have IP (copyright, trade secret, patent) protection, but the result would not have any IP protection. The Archivist may not be compelled to respond or act upon any “take-down” request for AI-created material, regardless of how scientific or academically correct a text may be, or how “lifelike” or youthful the subject in an AI-generated image appears to be.
In compliance with USC 18, any image of an underage person will be removed with an index entry indicating why the image is not maintained in this archive. As long as the age of the subject is stated or presumed to be over 18, then USC 18 is presumed not to apply.
Additionally, the Archivist, at their own option, may decline to maintain a public archive of material deemed objectionable or illegal, regardless of source or method of discovery, or method of determining the material is objectionable or illegal.
